1. Organizer

The organizer of the campaign is at all times exclusively Maris Food GmbH (hereinafter Maris Food), Neufelder Schanze 2, 27472 Cuxhaven. This promotion is in no way connected to Facebook & Instagram and is in no way sponsored, supported or organized by Facebook & Instagram.

2. Eligibility to participate

a) Any natural person over the age of 18 and resident in the Federal Republic of Germany is eligible to participate, with the exception of employees of the companies involved in the promotion and their relatives. Truthful personal details stating the participant's real name are required to process the prizes. The use of identities that are falsified or assigned to third parties is not permitted.
b) Eligible participants can take part in the competition by fulfilling the competition requirements specified in the competition post.
c) All participants may enter the competition with only one Facebook account or only one Instagram account.
d) The processing of the transferred personal data serves exclusively to carry out the competition. The participant is responsible for the accuracy of the data provided. The personal data will be deleted after the final completion of the competition or after the expiry of the tax and commercial retention regulations. However, Maris Food would like to point out that Meta holds the general customer data of the participants.

3. Exclusion from the prize

Participation in the competition is only permitted if all personal details (address) are true. Maris Food is entitled to exclude individual persons from participation if there are justified reasons, such as a breach of the conditions of participation, manipulation, etc.. In such a case, the prize may also be subsequently withdrawn and reclaimed. Participation on behalf of third parties, in particular by competition agencies, is not permitted. Prizes may not be transferred to third parties.

4. Duration of the competition

The start of the competition is the respective publication date of the competition post on the Appel Facebook page or the Appel Instagram page. Participation is only possible until the specified closing date. Please refer to the competition details on our Appel Facebook or Instagram page for the relevant times.

5. The prize

The prize will be determined by Maris Food and noted in the competition post on the Appel Facebook or Appel Instagram page. The prize will be sent by post to the address provided by the winner. If a delivery attempt fails, Maris Food is not obliged to make another delivery attempt. The prize is not transferable, nor can it be exchanged or paid out in cash.

6. Publication of the winners

The winners will be drawn at random after the end of the competition. Each participant agrees that, in the event of a win, he/she will be notified of the win by the Appel Facebook or Instagram page via a Facebook/Instagram comment or post stating the respective Facebook/Instagram name. (Variable:) Participants also agree that their submitted photos or images may be published on the Appel Facebook/Instagram page and/or in Appel media. Each winner must respond within 3 working days via a private message to the Appel Facebook page with their address details. If a winner does not respond within this period, the prize will be raffled again among all participants. Maris Food is not responsible for the accuracy of the e-mail address provided.

7. Premature termination of the competition

The organizer reserves the right to change, cancel or terminate the competition due to unforeseen circumstances without prior notice. The latter applies in particular if software and/or hardware errors occur and/or other technical and/or legal reasons influence the regular and proper execution of the competition or make it impossible. In such a case, the participants are not entitled to any claims against the organizer.

8. Legal information/exclusion of liability

Participants are responsible for the content of their entries. They undertake not to publish any contributions or share any content that violates legal provisions (e.g. insults, false facts, competition, trademark or copyright infringements). Maris Food accepts no liability whatsoever in the event of such infringements. Liability on the part of Maris Food is further excluded for damages of any kind that are based on circumstances that lie outside the area of responsibility of Maris Food. However, mandatory liability rules (in particular under food law regulations) are excluded from the above limitation of liability. Legal recourse is excluded. The law of the Federal Republic of Germany is exclusively applicable. Should any of these conditions be or become invalid, this shall not affect the validity of the remaining conditions of participation. Any ineffective clause shall be replaced by an economically comparable provision. By participating in the competition, participants accept the conditions of participation and data protection information listed here.

9. Data protection information

Maris Food GmbH (hereinafter referred to as Maris Food), Neufelder Schanze 2, 27472 Cuxhaven, Germany, is responsible for processing the personal data collected as part of the competition on the Appel Facebook or Instagram page.

Maris Food processes the voluntarily provided personal data in accordance with the legal provisions and exclusively for the duration of the implementation and processing of the competition on the basis of consent (legal basis: Art. 6 para. 1 lit. a GDPR) or for the fulfillment of a contract (legal basis: Art. 6 para. 1 lit. b GDPR).

Depending on the platform used, participants' Facebook name or Instagram name, surname, first name, address, date of birth and email address will be requested and processed as part of the competition. This personal data is processed and stored in particular to check the eligibility of participants and to send the prize.

Maris Food will process and/or store the personal data for the duration of the execution and handling of this Maris Food competition. If this data processing is no longer justified, e.g. by legal or contractual provisions, this data will be deleted as quickly as possible. Maris Food will not use the data for purposes other than those described in the terms and conditions of the competition. Data will not be transferred to third parties (no third parties in this sense are processors and/or shipping service providers).

Participants in the Maris Food competition are entitled to exercise the following rights in connection with their personal data:

(i) to request information from Maris Food as to whether and which personal data Maris Food has stored about you and to receive copies of this data,

(ii ) to request from Maris Food the rectification, completion or erasure of your personal data

(iii) require Maris Food to restrict the processing of your personal data; and/or

(iv) in certain legal circumstances, to object to the processing of your personal data by Maris Food

(v) request data portability from Maris Food,

(vi) lodge a complaint with the German data protection authority in Germany.

Furthermore, Maris Food hereby points out that the consent to the processing of your personal data in the context of this competition can be revoked by Maris Food at any time with effect for the future. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. In the event of revocation, the data will be deleted immediately after receipt of the declaration of revocation, provided that there are no legal retention periods to the contrary.
